Terms and conditions

(Translate it here)

All programs offered by Cara Norte are subject to the general conditions set forth herein.
Participation in Cara Norte activities implies agreement and acceptance of the following general conditions. From the moment the booking is confirmed, the client will assume all of these General Terms and Conditions of Contract. If a person registers others, they assume all these General Terms and Conditions on their behalf.
Please read them carefully, and if you have any questions, do not hesitate to contact Cara Norte (sos@caranorte.com).

  1. Identification details. The owner of Cara Norte is FERRAN MARTÍNEZ ESCÁMEZ with NIF 34766671D, a high-mountain guide with an international UIAGM credential, a Superior Sports Technician in High Mountain, registered in the “Official Register of Sports Professionals of Catalonia” (#328), the “Census of Organizers of Physical-Sports Activities in the Natural Environment” (#401), and the “Spanish Association of Mountain Guides” (#437). He holds an active liability insurance policy and an accident insurance policy for participants, as required by current regulations and legal conditions. His registered address is Bellver de Cerdanya (Lleida), 25720, phone number 0034627185053, and email sos@caranorte.com.
  2. Warning. For scheduled activities, Cara Norte will take all possible precautions to prevent any accidents. However, the client must be aware and acknowledge that, given the nature of mountain sports activities, the practices carried out involve a risk that must be assumed as a participant. All Technicians and Guides participating in Cara Norte activities are duly qualified, trained, and authorized to work in accordance with established laws. It is essential to always follow the advice, instructions, and safety guidelines of the Technicians and Guides to ensure the highest level of safety during the activity. Nevertheless, in the mountains, zero risk does not exist. All activities offered involve potential natural risks that are beyond human control and are therefore inherent.
  3. Client obligations. To prevent any foreseeable incidents, the client agrees to provide honest responses to pre-activity questionnaires, follow all decisions, guidelines, and safety orders given by the professional during the activity. Any deception or disobedience may result in the suspension of the scheduled activity as if it had been completed or may prevent a participant from continuing if they pose a danger to themselves or the group, resulting in the forfeiture of all rights. Participation in activities under the influence of alcohol and/or drugs is strictly prohibited. The consumption of such substances before or during activities is explicitly forbidden. Participants must meet the physical and mental requirements of each program and have the necessary equipment and materials for the activity they are taking part in.
  4. Environment. Most activities offered by Cara Norte take place in nature, a free but fragile environment that must be respected and preserved. Littering of any kind during activities is strictly prohibited.
Client negligence. Cara Norte disclaims all responsibility for any accident caused by recklessness, negligence, or carelessness of any participant, whether it occurs during or outside the scheduled activity times, which are determined by Cara Norte based on each activity.
  5. Required physical and technical conditions. Although Cara Norte conducts pre-activity consultations and/or questionnaires to better understand its participants, any activity may be canceled if, in the judgment of the technical management, the participant does not meet the required physical and technical conditions. In such a case, the technical management may propose an alternative activity more suited to the participant’s abilities, but is not obligated to do so.
  6. Trial tests and/or preparation. For highly demanding activities or courses, Cara Norte may opt to conduct a prior practical test to assess the participant’s level and better adapt to their needs, offering a more personalized service. The costs of this test will be borne by the client.
  7. Minors. Minors must present an original authorization with parental consent on the first day of the course and/or activity, along with a photocopy of the parent’s or legal guardian’s ID and a contact phone number. Without this consent and information, they will not be allowed to participate.
  8. Image rights. Participants in our activities expressly authorize Cara Norte, without any right to compensation, to take photos and videos for the purpose of providing a keepsake of the experience and for sharing on our media and channels.
  9. Health. Clients are responsible for presenting a document stating any illness, allergy, etc., to avoid risks during the contracted activities or courses. These details will be treated with absolute privacy.
  10. Transportation. The participant is responsible for the cost and responsibility of transportation to the location of the course or activity unless transportation is included in the program or if unexpected costs arise.
Inappropriate equipment and technical materials. The technical management of the activity reserves the right to accept client-supplied technical materials not provided by Cara Norte. If client-provided materials are accepted, there will be no price reduction for the activity.
  11. Lack of required equipment and materials. To prevent potential risks due to missing essential equipment or materials, the activity leaders may suspend or delay the activity until the issue is resolved. If the problem is attributable to the participant, the program may proceed without them.
  12. Equipment rental. For introductory courses and/or activities, Cara Norte will facilitate the rental of collective safety equipment unless, due to complexity or particular circumstances, the participant must provide it. Each activity will specify the necessary materials.
  13. Lost or damaged rented/borrowed equipment. If a participant loses or negligently damages any rented or borrowed equipment from Cara Norte, they must pay for its replacement.
Personal equipment and materials. Cara Norte is not responsible for the deterioration or loss of personal belongings during the activity.
  14. Accident and liability insurance. All Cara Norte activities include liability insurance and accident insurance for participants. These policies comply with current regulations. However, accident and liability insurance do not cover cancellations, medical expenses, or travel costs.
  15. Prices and group size. The cost of any group activity, whether courses, guided ascents, etc., is subject to the established pricing based on the number of participants. If a minimum group size is not met, a proportional surcharge will be applied. Alternatively, the client may choose a similar program or wait for additional participants to reach the minimum required group size.
  16. Guide expenses. There are no additional costs for guide transportation and meals within the Cerdanya area. For activities outside Cerdanya, extra charges for travel, accommodation, and meals will apply.
  17. Punctuality. To ensure smooth operations, participants must be punctual. In some cases, the technical management may start the activity without late arrivals, who will have no right to claim refunds.
  18. Booking and reservations. To book an activity with Cara Norte, a transfer of at least 50% of the total activity price must be made to the following bank account:
    Beneficiary: Cara Norte
    Bank: Triodos
    Account number: 1491 0001 22 2007006626
    IBAN: ES68 1491 0001 2220 0700 6626
    BIC: TRIOESMMXXX
When making the transfer, it is necessary to specify the activity, the dates, the participant’s full name, and send the corresponding proof of payment to sos@caranorte.com.
  19. Deadlines for Finalizing the Reservation. Registration is on a first-come, first-served basis according to the completion of the reservation, so it is advisable not to delay the deposit payment to secure a spot in the requested activity and dates. Once the deposit is paid, the remaining balance must be paid no later than 10 days before the activity starts. If reserving an activity with less than 10 days’ notice, 100% of the activity price must be paid via bank transfer, or alternatively, 50% as a deposit, with the remaining amount to be paid in cash on the day of the activity. Please note that we do not accept payments via Bizum.
For reservations made less than 3 business days* in advance, payment must be made in cash on the day of the activity.
    *3 working days.
  20. Start of the Activity. Once the reservation is confirmed, if the activity or course includes online theory, a theoretical presentation session before the activity, or technical advice, the services provided by Cara Norte will be considered as having begun.
  21. Cancellations and Modifications by Cara Norte After the Activity Has Started Due to Force Majeure. Any modification or suspension of the activity once it has started due to force majeure beyond the organization’s control—such as natural disasters, political issues, or forced evacuations—will not result in any refund or substitution of the activity.
  22. Cancellations by Cara Norte Before the Activity Starts. We understand the logistical complexity involved in participating in some of Cara Norte’s activities. For programs requiring significant logistical arrangements by participants (e.g., long trips, reservations, and accommodations before and/or after the activity, taking leave from work, etc.), we always have alternative plans in case mountain conditions advise against proceeding, following the technical director’s judgment. If no alternative plans are possible due to force majeure (e.g., natural disasters, political issues), the client may recover the amount paid, deducting—if applicable—bank fees, management fees, costs related to advisory services and provided documentation, and other associated reservations such as mountain refuges, travel agencies, flights, or accommodations, whose conditions and/or bookings do not depend on Cara Norte. Please check specific conditions for each program.
It is important to clarify that a simple forecast of bad weather is not, in itself, a force majeure reason for canceling an activity in advance. Meteorological forecasts, despite using mathematical and physical models, remain estimations that may be subject to errors and deviations from what is ultimately experienced. Forecasts for several days in advance are likely to change, and their reliability tends to improve as the date approaches. However, in complex weather situations, uncertainty may persist until the day of the activity.
  23. Cancellations by the Client. Due to our policy of personalized activities with small groups and the significant prior preparation and logistics involved, confirmed activities cannot be refunded or modified by the client. For this reason, it is important to be certain about the chosen activity and dates before making a reservation. Additionally, it is always advisable to purchase cancellation insurance to cover any force majeure event that may prevent participation, ensuring that the reservation and any related travel expenses are not lost. In case of cancellation due to restrictions from a declared State of Alarm or government-imposed limitations that prevent the activity from taking place, the client will have the right to reschedule for the same or an equivalent activity at a later date. Alternatively—though this would be the least favorable option for us—they may request a refund of the amount paid, deducting (if applicable) bank fees, management fees, costs related to provided theoretical documentation, and other associated reservation costs (such as mountain refuges, travel agencies, flights, or accommodations), whose conditions are beyond Cara Norte’s control. Please check specific conditions for each case.
  24. Cancellations Due to Not Meeting the Minimum Group Requirement. We always recommend private activities to avoid dependency on other participants. For open group activities that require a minimum number of independently registered participants, we will ask participants to provide at least two alternative dates. If the minimum number of participants is not met, we may offer a special price adjustment for a smaller group or reschedule the activity for the next available alternative date.
  25. Applicable Law and Jurisdiction. The relationship between Cara Norte and the user will be governed by current Spanish regulations, and any dispute will be subject to the jurisdiction of the courts in La Seu d’Urgell.
  26. Other Cases. Any situation not covered in these terms will be resolved by the management of Cara Norte.
  27. Voluntary Acceptance. Users of our website and services acknowledge and voluntarily accept all the above conditions.
